Tech Council and business groups want privacy reform narrowed

The Tech Council of Australia wants to narrow the scope of a proposed tort for serious invasions of privacy, expressing concerns about the additional costs that the measures could create.

Appearing before the Senate inquiry into the Privacy Act reform bill on Tuesday, the Tech Council’s new head of policy and strategy Harry Godber says without adding a threshold of serious harm, the courts would be inundated with claims and class action suits.

The new tort is the only recommendation of the Privacy Act review that the government agreed to in-principle that’s included in the bill, although the Attorney’s General’s Department told the inquiry it plans to consult on draft provisions for a second tranche of reforms by the end of the year.
