Govt warned on use of AI as ‘decision making authority’

Clauses in existing legislation that let Commonwealth departmental secretaries outsource ‘decision-making authority’ to computers is like leaving a “hand grenade with the pin out”, a regulation and governance specialist has warned.

Experts at the UNSW Allens Hub for Technology, Law, and Innovation and the UNSW Business School Regulatory Laboratory have called for the removal of clauses from several pieces of administrative law in a submission to the Industry department’s consultation on ‘Responsible AI in Australia’.

Speaking at the TechLeader’s summit on Monday, Associate Professor Rob Nicholls said “there are 20 pieces of current legislation which include the phrase ‘may arrange for use of computer programs to make decisions’,” which give departmental secretaries the power to delegate decision making authority to computer systems.
